
Justice Centre provided a submission to the Constitutional and Mainland Affairs Bureau in relation to Hong Kong’s sixth report under the Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) in the context of forced migration.
The report discussed the general legal framework of non-refoulement protection in Hong Kong, as well as specific issues pertaining to different articles of the CAT pertaining to refugees and asylum seekers in Hong Kong, including:
- Torture as a ground for refusal to expel, return or extradite
- Powers of detention
- Review of interrogation rules, instructions, methods and practices for custody and treatment of persons arrested or detained
- Right of complaint
